It was in 2006 that Nagrik Chetna Manch launched the case regarding irregularities in the grant of TDR at Kothrud. We had then asked for donations from well-wishers. We did receive a fair response due to which we could continue the case (No PIL/127/2006) in Bombay High Court.
We have five court cases as follows: a) two in the Municipal Court against so-called ‘study’ tours of councillors (1/2005 & 772/2005), b) three PILs in Bombay High Court against the Bal-Bharati Paud Road (156/2006), Flyovers (73/2010) and the Kothrud TDR Case and c) a PIL in the Supreme Court (IA 2079/2007) against irregular conversion of Reserved Forest of about 30 acres for residential purposes. Nagrik Chetna Manch is not paying for the cases in the Municipal Court.
The total suspected amount involved in all the cases comes to over Rs. 1500 Crores at today’s prices. The Bombay High Court is awaiting the outcome of the surveys for EIA and traffic to establish the need for BB-Paud Road. The TDR case is at a crucial stage with our thrust being to hold accountable all those responsible for the fraud including the senior officers. Our prayer in the flyover case is to direct the municipal corporation to follow strictly the guidelines issued in this regard by the Indian Roads Congress and not spend huge amounts where IRC does not recommend a flyover. The reserved forest case is again at a crucial stage with the amicus curae making his submissions before the Hon'ble Supreme Court. Our stand is the same as that presented by the amicus curae on behalf of the Central Empowered Committee.
We are now running out of funds although the lawyers that Nagrik Chetna Manch has hired are largely charging only the actual expenses and for the juniors who assist our counsels.
Our CA audits our accounts regularly and we submit the same to the Income Tax Department and the Charity Commissioner. There have been no objections/observations so far. Our certificate of exemption u/s 80G is valid until A/Y 2012-2013.
